Ontario Pest Control Terms & Conditions
1. Pests to be Controlled
See front of Protection Agreement. The only obligation of Insight Pest Solutions (hereinafter referred to as COMPANY or INSIGHT) under this agreement is to provide the treatments for pests as outlined and in accordance to the terms and conditions as outlined on the front of this agreement.
1.b) Carpenter Ant Warranty and Treatment
Activity inside as well as around the immediate property of the location as identified on the front of this agreement, shall be covered. COMPANY agrees to treat any carpenter ant activity. If Insight is unable to control and/or eliminate the interior carpenter ant activity if any exists, after no fewer than 3 treatments within the quarterly period (3-months) of this agreement, then the customer is entitled to stop the service agreement with no fee, and receive a refund for monies paid for the last charge. There shall be no additional charges, other than indicated on the front of the agreement, to treat any carpenter ant activity in the property identified on the front of this agreement, as well as the immediately surrounding property, if the carpenter ant coverage is selected on the front of this agreement.
2. Customer Agreement
Customer agrees to receive and pay for the treatment outlined on this agreement and to make the premises available to COMPANY to perform such treatments and contain their pets.
3. Future Damage & Limitation of Liability
- This does not guarantee against present or future insect damage to buildings or contents nor provide for repair or compensation.
- This agreement does not provide for the control or prevention of termites or any other wood-destroying insects, organisms, or any other pest not identified herein, except carpenter ants if the carpenter ant coverage is selected. CUSTOMER expressly waives and releases COMPANY from any liability and/or for any claim for personal injury or damages to the structure or its contents caused by wood-destroying insects, organisms, or any other arthropods listed or not listed in this agreement.
- COMPANY does not guarantee against the elimination of bed bugs or against the present or future presence of any other arthropod or pests. COMPANY is not liable for any actual or consequential damages to the property or its contents sustained by the customer as a result of bed bugs or any other arthropods or pests. COMPANY is not liable for any form of repairs to buildings or its contents. COMPANY is not liable for any injury or damages resulting from contact with any product used by COMPANY to treat the premises.
4. Cancellation
This agreement may not be cancelled by email. In order to discontinue service, customer agrees that they will speak to a member of Insight's customer service team either over the phone by calling our offices at 855-489-3640, or by visiting one of our local branch offices, and also agrees that they will do so no less than 30 days prior to the next scheduled service. Cancellation prior to the completion of the initial 12-month agreement period will result in customer being required to pay an early termination fee as indicated on the front of this agreement if the initial 10-day cancellation period has elapsed. If you cancel this agreement within the 10-day period, you are entitled to receive a full refund for all services rendered, and must return all goods installed at the service premises at no cost to customer.
THERE IS NO CANCELLATION CHARGE AFTER THE INITIAL 12-MONTH PERIOD. Should customer choose to refuse service either upon arrival of service technician at the premises or less than 30 days before the next scheduled service visit and the INITIAL SERVICE has already been performed AND the 10-day cancellation period has elapsed, customer shall be charged as indicated on this service agreement for that quarterly period.
THERE IS NO CHARGE TO CANCEL THIS AGREEMENT EITHER BEFORE THE INITIAL SERVICE HAS BEEN PERFORMED, NOR AFTER THE INITIAL 12-MONTH PERIOD HAS ELAPSED.
5. Schedule of Treatments
COMPANY will treat the premises on a quarterly schedule (+/- 15 days) from the month indicated in the SCHEDULE section on the front of this agreement. COMPANY reserves the right to change the treatment schedule if it becomes necessary, however will advise customer should this occur.
6. Disclaimer
COMPANY's liability under this agreement will be terminated if COMPANY is prevented from fulfilling its responsibilities under the terms of this agreement by reason of transportation shortages of fuel and/or materials, strikes, embargoes, fire, floods, quarantine restrictions, natural disasters, or any other act of God or circumstances or cause beyond the control of the COMPANY.
7. Notification
Customer agrees to notify COMPANY prior to treatments of any occupants that are allergic or sensitive to the products used. In addition, customer agrees not to tamper, modify, or move pest control devices used for pest control protection.
8. Price Adjustments
Customer acknowledges that the price of the service provided may need to increase over time, as a result of economic inflation and/or the increased costs of providing the high quality of service that customers have come to expect from Insight. COMPANY agrees that there shall be no increase in price during the customer's initial one-year service term. If COMPANY increases the price of service after the initial one-year service term, COMPANY will send PURCHASER, at least 30 days before the change comes into force, a written notice setting out the new price and the date of the coming into force of the price increase. PURCHASER may refuse the price increase and cancel the contract without cost, penalty or cancellation indemnity by sending the COMPANY a notice to that effect no later than 30 days after the price increase comes into force.
UPON REQUEST, COMPANY WILL PROVIDE THE PURCHASER WITH A COPY OF THE MSDS SHEET OF THE PESTICIDE(S) USED TO TREAT THE PREMISES.
Buyer's Right to Cancel
Your Rights under the Consumer Protection Act, 2002: You may cancel this agreement at any time during the period that ends ten (10) days after the day you receive a written copy of the agreement. You do not need to give the supplier a reason for cancelling during this 10-day period.
If the supplier does not make delivery within 30 days after the delivery date specified in this agreement or if the supplier does not begin performance of his, her or its obligations within 30 days after the commencement date specified in this agreement, you may cancel this agreement at any time before delivery or commencement of performance. You lose the right to cancel if, after the 30-day period has expired, you agree to accept delivery or authorize commencement of performance.
If the delivery date or commencement date is not specified in this agreement and the supplier does not deliver or commence performance within 30 days after the date this agreement is entered into, you may cancel this agreement at any time before delivery or commencement of performance. You lose the right to cancel if, after the 30-day period has expired, you agree to accept delivery or authorize commencement of performance.
In addition, there are other grounds that allow you to cancel this agreement. You may also have other rights, duties and remedies at law. For more information, you may contact the Ministry of Government and Consumer Services.
To cancel this agreement, you must give notice of cancellation to the supplier, at the address set out in the agreement, by any means that allows you to prove the date on which you gave notice. If no address is set out in the agreement, use any address of the supplier that is on record with the Government of Ontario or the Government of Canada or is known by you.
If you cancel this agreement, the supplier has fifteen (15) days after receipt of your notice of cancellation to refund any amounts you paid for the services and the agreement is void. The supplier is not entitled to any payment for services provided before you cancel.
Ontario Pest Control Terms & Conditions

- This agreement does not provide for the control or prevention of termites or any other wood-destroying insects, organisms, or any other pest not identified herein, except carpenter ants if the carpenter ant coverage is selected. CUSTOMER expressly waives and releases COMPANY from any liability and/or for any claim for personal injury or damages to the structure or its contents caused by wood-destroying insects, organisms, or any other arthropods listed or not listed in this agreement.
- COMPANY does not guarantee against the elimination of bed bugs or against the present or future presence of any other arthropod or pests. COMPANY is not liable for any actual or consequential damages to the property or its contents sustained by the customer as a result of bed bugs or any other arthropods or pests. COMPANY is not liable for any form of repairs to buildings or its contents. COMPANY is not liable for any injury or damages resulting from contact with any product used by COMPANY to treat the premises.
4. Cancellation
This agreement may not be cancelled by email. In order to discontinue service, customer agrees that they will speak to a member of Insight's customer service team either over the phone by calling our offices at 855-489-3640, or by visiting one of our local branch offices, and also agrees that they will do so no less than 30 days prior to the next scheduled service. Cancellation prior to the completion of the initial 12-month agreement period will result in customer being required to pay an early termination fee as indicated on the front of this agreement if the initial 10-day cancellation period has elapsed. If you cancel this agreement within the 10-day period, you are entitled to receive a full refund for all services rendered, and must return all goods installed at the service premises at no cost to customer.

8. Price Adjustments
Customer acknowledges that the price of the service provided may need to increase over time, as a result of economic inflation and/or the increased costs of providing the high quality of service that customers have come to expect from Insight. COMPANY agrees that there shall be no increase in price during the customer's initial one-year service term. If COMPANY increases the price of service after the initial one-year service term, COMPANY will send PURCHASER, at least 30 days before the change comes into force, a written notice setting out the new price and the date of the coming into force of the price increase. PURCHASER may refuse the price increase and cancel the contract without cost, penalty or cancellation indemnity by sending the COMPANY a notice to that effect no later than 30 days after the price increase comes into force.
UPON REQUEST, COMPANY WILL PROVIDE THE PURCHASER WITH A COPY OF THE MSDS SHEET OF THE PESTICIDE(S) USED TO TREAT THE PREMISES.

For more information, you may contact your provincial/territorial consumer affairs office.
If you cancel this contract, the seller has 15 days to refund your money and any trade-in, or the cash value of the trade-in. You must then return the goods.
To cancel, you must give notice of cancellation at the address in this contract. You must give notice of cancellation by a method that will allow you to prove that you gave notice, including registered mail, fax or by personal delivery.

4. Cancellation
This agreement may not be cancelled by email. In order to discontinue service, customer agrees that they will speak to a member of Insight's customer service team either over the phone by calling our offices at 855-489-3640, or by visiting one of our local branch offices, and also agrees that they will do so no less than 30 days prior to the next scheduled service. Cancellation prior to the completion of the initial 12-month agreement period will result in customer being required to pay an early termination fee as indicated on the front of this agreement if the initial 10-day cancellation period has elapsed. If you cancel this agreement within the 10-day period, you are entitled to receive a full refund for all services rendered, and must return all goods installed at the service premises at no cost to customer.
THERE IS NO CANCELLATION CHARGE AFTER THE INITIAL 12-MONTH PERIOD. Should customer choose to refuse service either upon arrival of service technician at the premises or less than 30 days before the next scheduled service visit and the INITIAL SERVICE has already been performed AND the 10-day cancellation period has elapsed, customer shall be charged as indicated on this service agreement for that quarterly period.

COMPANY's liability under this agreement will be terminated if COMPANY is prevented from fulfilling its responsibilities under the terms of this agreement by reason of transportation shortages of fuel and/or materials, strikes, embargoes, fire, floods, quarantine restrictions, natural disasters, or any other act of God or circumstances or cause beyond the control of the COMPANY.
7. Notification
Customer agrees to notify COMPANY prior to treatments of any occupants that are allergic or sensitive to the products used. In addition, customer agrees not to tamper, modify, or move pest control devices used for pest control protection.
8. Price Adjustments
Customer acknowledges that the price of the service provided may need to increase over time, as a result of economic inflation and/or the increased costs of providing the high quality of service that customers have come to expect from Insight. COMPANY agrees that there shall be no increase in price during the customer's initial one-year service term. If COMPANY increases the price of service after the initial one-year service term, COMPANY will send PURCHASER, at least 30 days before the change comes into force, a written notice setting out the new price and the date of the coming into force of the price increase. PURCHASER may refuse the price increase and cancel the contract without cost, penalty or cancellation indemnity by sending the COMPANY a notice to that effect no later than 30 days after the price increase comes into force.
UPON REQUEST, COMPANY WILL PROVIDE THE PURCHASER WITH A COPY OF THE MSDS SHEET OF THE PESTICIDE(S) USED TO TREAT THE PREMISES.
Buyer's Right to Cancel
You may cancel this contract from the day you enter into the contract until 1O days after you receive a copy of the contract. You do not need a reason to cancel.
If you do not receive the goods or services within 30 days of the date stated in the contract, you may cancel this contract within one year of the contract date. You lose that right if you accept delivery after the 30 days. There are other grounds for extended cancellation. 1.b) Carpenter Ant Warranty and Treatment
Activity inside as well as around the immediate property of the location as identified on the front of this agreement, shall be covered. COMPANY agrees to treat any carpenter ant activity. If Insight is unable to control and/or eliminate the interior carpenter ant activity if any exists, after no fewer than 3 treatments within the quarterly period (3-months) of this agreement, then the customer is entitled to stop the service agreement with no fee, and receive a refund for monies paid for the last charge. There shall be no additional charges, other than indicated on the front of the agreement, to treat any carpenter ant activity in the property identified on the front of this agreement, as well as the immediately surrounding property, if the carpenter ant coverage is selected on the front of this agreement.
